Paternity Leave in the Philippines

Paternity leave in the Philippines is a legally mandated benefit for married male employees whose spouse gives birth, suffers a miscarriage, or undergoes emergency pregnancy termination. While many people assume it is connected to SSS, the truth is simpler: paternity leave is not an SSS benefit. It is entirely paid by the employer under Republic Act 8187, also known as the Paternity Leave Act of 1996.

Is Paternity Leave Paid by SSS?

No. There is no SSS paternity benefit and no reimbursement from SSS. The Social Security System only pays for maternity benefits, not paternity leave.

"The employer shall pay the employee the paternity leave benefit."

Who Can Avail of Paternity Leave?

  • Married to the mother of the child
  • Currently employed in the Philippines
  • Living with the spouse at childbirth
  • Has notified the employer of the pregnancy
  • Childbirth or miscarriage happened while employed

How Many Days of Paternity Leave Are Allowed?

The law grants up to 7 days of paid paternity leave for the first four (4) deliveries or miscarriages.

How Is Paternity Leave Pay Computed?

Daily Salary X Number of Leave Days (max 7)

Example:
Daily salary: ₱900
Leave days: 7 -> ₱6,300 total

Why Isn't SSS Involved?

Paternity leave is a labor law benefit, not a social insurance benefit. SSS only pays maternity, sickness, disability, unemployment, retirement, and death benefits.

Can OFWs Avail?

No - unless they have a Philippine employer with an active employer-employee relationship.

Can It Be Taken Immediately After Birth?

Yes. Fathers may take it on the day of delivery or shortly afterward.

If Not Married?

Unmarried fathers are not legally entitled to paternity leave under RA 8187.
